These Terms govern your use of exfog.com and your purchase of products from us. The site is operated by Battlewear Components Inc., doing business as ExFog (“ExFog”, “we”, “us”), of 56179 Dana Drive, Bristol, Indiana 46507, United States. By using the site or placing an order, you accept these Terms. If you do not accept them, please do not use the site.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By ordering you confirm that the information you give us is accurate and that you are authorised to use the payment method you provide.

2. Products and descriptions

We try to describe and photograph our products accurately, but colours, finishes and packaging can vary, and we do not warrant that every description on the site is complete or free of error. ExFog is an anti-fog system for eyewear used in airsoft, paintball and similar activities. It is not safety equipment and does not replace eye protection rated for your activity. Always use eye protection appropriate to what you are doing, and follow the instructions supplied with the product.

3. Prices, orders and acceptance

Prices are in U.S. dollars and may change without notice. Placing an order is an offer to buy; your order is accepted only when we confirm shipment. We may decline or cancel an order — including after it has been placed — where the product is unavailable, where a price or description was listed in error, where we suspect fraud or unauthorised resale, or where we cannot verify the information you gave us. If we cancel an order you have already paid for, we will refund it in full.

You are responsible for any sales, use or import tax that applies to your order, except where we are required to collect it at checkout.

4. Shipping, delivery and risk of loss

We ship from Bristol, Indiana. Delivery estimates are estimates, not guarantees, and we are not liable for carrier delays. Title and risk of loss pass to you when the carrier takes possession of the shipment.

For international orders, you are the importer of record. Customs duties, import taxes and brokerage fees are your responsibility and are not included in the price you pay us. Please check your own country’s rules before ordering — refused or abandoned shipments are not refundable beyond the product price, and any cost of return falls to you.

5. Returns and warranty

Our one-year limited warranty, what it covers, what voids it, and how to make a claim are set out on our Returns & Warranty page, which forms part of these Terms. Two points are worth repeating here:

  • The limited warranty applies only to product purchased from an authorised ExFog dealer in the United States or U.S. territories, or directly from exfog.com. It is not valid for product purchased outside the United States and U.S. territories, and it does not cover product bought from an unauthorised reseller, wherever located.
  • Freight and transportation charges on a warranty return are borne by the customer.

6. Resale and authorised dealers

ExFog products sold through this site are sold for end use. Purchase for resale requires a written dealer agreement with us. Resale on a marketplace or storefront without that agreement is not authorised, voids the limited warranty on the product resold, and may result in the refusal of future orders.

Authorised dealers are separately bound by their dealer agreement, including its minimum advertised price terms and its obligation to return warranty product to us within 15 days of receipt. Nothing on this page limits or replaces that agreement.

7. Intellectual property

ExFog® is a registered trademark of Battlewear Components Inc. The ExFog system is protected by U.S. patent. All content on this site — text, photographs, video, diagrams, instructions and the site design itself — is owned by us or used with permission and is protected by copyright.

You may not copy, reproduce, republish or distribute site content for commercial purposes without our written permission, and you may not use the ExFog name, logo or product images to market your own goods or services. Dealers may use the assets we supply them, for the purpose we supply them.

8. Acceptable use

Do not use this site to break the law, to interfere with its operation or security, to scrape it by automated means, or to submit content that is unlawful, misleading or infringing. Anything you send us — a review, a question, a photograph, a suggestion — may be used by us in connection with our business without payment or attribution, and you confirm you have the right to send it.

9. Third-party links and services

The site links to and relies on services we do not control, including payment processors, shipping carriers, and the sites of our dealers. We are not responsible for their content, practices or terms.

10. Disclaimer

EXCEPT FOR THE LIMITED WARRANTY DESCRIBED ON OUR RETURNS & WARRANTY PAGE, THE SITE AND THE PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXFOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA OR LOSS OF USE, ARISING OUT OF OR RELATING TO THE SITE OR THE PRODUCTS, WHETHER IN CONTRACT, TORT, WARRANTY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FOR FRAUD, WHERE THAT LIMITATION IS PROHIBITED BY LAW.

12. Assumption of risk

Airsoft, paintball and similar activities carry inherent risk of injury. You assume that risk. You are responsible for using eye protection rated for your activity, for playing only where projectile velocity limits are enforced, and for following the instructions supplied with any product you buy from us.

13. Indemnity

You agree to indemnify and hold harmless Battlewear Components Inc., its officers and employees from any claim arising out of your misuse of a product, your breach of these Terms, or your violation of any law or third-party right.

14. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

15. Governing law and venue

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Elkhart County, Indiana, and you consent to their jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. General

If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Returns & Warranty page and the Privacy Policy, are the entire agreement between us regarding the site and your purchase, and they supersede any prior understanding. We may update these Terms at any time; the effective date above shows when they were last revised, and orders are governed by the version in effect when the order is placed.
