This policy explains what personal information ExFog collects, why we collect it, who we share it with, and what you can do about it. We have tried to write it in plain language rather than legal boilerplate.

The site exfog.com and the ExFog® product line are operated by Battlewear Components Inc., doing business as ExFog, of 56179 Dana Drive, Bristol, Indiana 46507, United States. In this policy “we”, “us” and “ExFog” mean that company.

1. Information you give us

  • Orders. Your name, billing and shipping address, email address, phone number and what you bought. We need these to take payment and get the product to you.
  • Payment details. Handled by our payment providers, not by us — see section 4.
  • Account and wishlist. If you create an account, your username, email address and saved preferences.
  • Contact and dealer enquiries. Anything you put in a form on this site, or send to us by email, live chat or telephone — including dealer applications.
  • Support. If you contact us about a problem, whatever you tell us about it, and any photographs or video you send.
  • Warranty claims. Proof of purchase and the details of the claim.
  • Reviews and content. Anything you post publicly on our site or our social channels.

2. Information collected automatically

When you visit exfog.com we and the services listed in section 6 may collect your IP address, approximate location derived from it, device and browser type, the pages you view, what you click, how you arrived at the site, and what you add to your cart or buy.

Some of this is necessary for the site to function — keeping your cart intact, keeping you logged in, protecting against fraud. The rest is analytics and advertising, and depends on your cookie choices.

3. Telephone calls

Some of the telephone numbers shown on this site are routed through a call-tracking service, which records the number you called from, the time and duration of the call, and which page or advertisement led you to call. This helps us understand which marketing is working. Calls may also be recorded for training and quality purposes; if a call is being recorded you will be told at the start of it.

4. Payments

We do not see or store your full card number. Payments are processed by:

  • WooCommerce Payments (powered by Stripe) for card payments
  • PayPal, if you choose to pay that way
  • Affirm, if you choose to pay over time

Each of these receives the information it needs to process your payment and handles it under its own privacy policy. Affirm is a credit product: if you apply, Affirm collects additional information directly from you and may check your credit. That application is between you and Affirm, and we do not receive your credit report.

5. How we use your information

  • To take, fulfil, ship and invoice your order, and to handle returns and warranty claims
  • To answer your questions and provide support
  • To manage dealer relationships and applications
  • To keep our accounts, meet tax obligations and prevent fraud
  • To understand how the site is used and improve it
  • To advertise our products, and to measure whether that advertising works
  • To send you email you have asked for, which you can stop at any time

6. Cookies, analytics and advertising

We use cookies and similar technologies. The ones that are strictly necessary — your cart, your login, security — are always on, because the site cannot work without them. Others are set for analytics and advertising, as described below.

The following third-party services may set cookies or receive information about your visit:

  • Google Tag Manager — manages the tags below
  • Meta (Facebook and Instagram) — the Meta pixel and our product catalogue integration, used to measure advertising and show you ExFog ads on Meta platforms
  • TikTok — advertising measurement
  • Jetpack / Automattic — site statistics
  • Google Fonts — serves the typefaces this site uses
  • NitroPack — page speed and caching
  • Zendesk — our support chat widget, if you use it

Managing your choices. A consent notice appears when you first visit this site. Because we are a United States business, we operate an opt-out model: analytics and advertising cookies are set when you arrive, and you can switch them off at any time. Use the Your Privacy Choices link in the footer, or the Deny option on the notice itself. Choosing to opt out stops the advertising tags, including the Meta pixel, from loading.

We honour Global Privacy Control signals where your browser sends one. You can also block or delete cookies through your browser settings, though blocking necessary cookies will break checkout.

7. Who we share information with

We do not sell your personal information for money. We share it only as follows:

  • Payment providers — as described in section 4
  • Shipping carriers — your name, address and contact details, so they can deliver
  • Authorised dealers — if you ask us to put you in touch with one, or if a warranty claim runs through one
  • Service providers who run parts of our business on our behalf: web hosting, our web agency, email delivery, customer support, call tracking, and our accounting system (Intuit QuickBooks)
  • Advertising and analytics platforms — as described in section 6
  • When the law requires it, or to protect our rights, safety or property
  • In a business sale, if ExFog or its assets are ever sold or merged

Service providers may use your information only to do the job we have engaged them for.

A note on advertising. California and several other states define sharing information with advertising platforms as a “sale” or “sharing” of personal information, even though no money changes hands. On that definition, our use of the Meta and TikTok tags is a sale or sharing. You can switch it off — see section 6, and section 9.

8. International visitors

We are based in the United States and your information is processed there. If you are in the European Economic Area, the United Kingdom or Switzerland, the United States may not offer the same level of legal protection as your home country. Where we transfer information internationally we rely on appropriate safeguards, such as the European Commission’s standard contractual clauses.

Where the GDPR applies to you, our legal bases are: performance of a contract (processing your order), legitimate interests (running and securing our business, preventing fraud), consent (advertising cookies and marketing email, which you can withdraw), and legal obligation (tax and accounting records).

9. Your rights

Depending on where you live, you may have the right to:

  • Know what personal information we hold about you, and get a copy of it
  • Correct information that is wrong
  • Delete information we no longer need to keep
  • Opt out of targeted advertising, and of the “sale” or “sharing” described in section 7
  • Withdraw consent you have previously given
  • Not be discriminated against for exercising any of these rights

To exercise any of them, email [email protected] or write to us at the address in section 13. We will ask you to verify your identity, because we are not going to hand someone’s order history to a stranger. We aim to respond within 45 days, and will tell you if we need longer.

An authorised agent may make a request on your behalf with written proof of authorisation.

10. How long we keep it

  • Order and invoice records — at least seven years, because tax and accounting law requires it
  • Warranty records — for the warranty period and a reasonable time after, so we can verify a claim
  • Support correspondence — while it is useful for supporting you
  • Account and wishlist data — until you ask us to delete it
  • Analytics and advertising data — per the retention periods of the services in section 6

11. Security

The site runs over HTTPS, payment details go directly to our payment providers rather than through our systems, and access to order data is limited to the people who need it. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. If a breach affects your information we will notify you as required by law.

12. Children

This site is not directed at children under 13, and we do not knowingly collect their personal information. Our products are intended to be bought by adults. If you believe a child has given us personal information, contact us and we will delete it.

13. Changes and contact

We may update this policy. The effective date above shows when it was last revised, and material changes will be flagged on this page.
